These terms are an agreement between you and Kyle Le, a sole proprietor in Alberta, Canada ("we", "us"), covering your use of the Ganba iOS app.
By downloading or using Ganba, you agree to these terms. If you do not agree, do not use the app.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Ganba on Apple devices you own or control, for your own learning.
You may not: resell, sublicense, or redistribute the app; extract, scrape, or republish its content as a dataset or competing product; reverse engineer it except where that restriction is unenforceable by law; or use it to break any law.
We keep all rights not expressly granted here, including in the app's name, design, mascot, and code.
Ganba is free to use with a portion of its content. Ganba Premium unlocks the rest and is sold as a monthly subscription, an annual subscription, or a one-time lifetime purchase.
All purchases are processed by Apple, through your Apple Account. We never see or handle your payment details.
Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Your Apple Account is charged for renewal within 24 hours of the period ending. The lifetime purchase is a single payment and does not renew.
Where a free trial is offered, the price and the date of the first charge are shown before the trial begins. If a trial is running, we will remind you inside the app before it converts to a paid subscription. If you cancel before the trial ends, you are not charged. Any unused portion of a trial is forfeited if you buy a subscription during it.
You can cancel at any time in your Apple Account subscription settings, reachable in two taps from Ganba's Settings screen. Cancelling is never harder than subscribing. Cancelling stops the next renewal; you keep access until the end of the period you have already paid for.
If a price changes, Apple will notify you and, where required, ask you to consent before the new price applies. A price change never applies to a period you have already paid for, and never to a lifetime purchase.
Refunds are handled by Apple under Apple's own policies, not by us. We can't issue refunds directly, but if something has gone wrong, contact support@ganba.ca and we will help where we can.
The Japanese content in Ganba draws on openly licensed sources, used in accordance with their licences:
Those sources remain the property of their respective owners under their own terms.
Ganba is a study tool. We do not promise any particular result, score, exam outcome, or level of fluency. What you get out of it depends on your own effort.
We work hard on accuracy and every item is human-reviewed, but language is nuanced and mistakes are possible. Do not rely on Ganba as your only source for anything that matters, such as an exam, a legal document, or a medical situation.
Ganba is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or that any defect will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or study progress, arising out of your use of Ganba, even if we have been advised such damages are possible.
Our total liability to you for any claim relating to Ganba is limited to the greater of (a) the amount you actually paid us for Ganba in the twelve months before the claim, or (b) CAD $50.
Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your misuse of Ganba, your breach of these terms, or your violation of any law or third-party right.
You may stop using Ganba at any time by deleting it.
We may suspend or terminate your access if you breach these terms, misuse the app, or attempt to harm the service or other users. Where it is reasonable to do so, we will give notice first. Sections 3 through 9 survive termination.
If we terminate your access without cause while you hold a paid subscription, we will arrange a pro-rata refund for the unused period through Apple where possible.
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts of Alberta have exclusive jurisdiction, and you consent to that venue.
If you are a consumer, this does not deprive you of the protection of mandatory consumer laws in your country of residence, and you may have the right to bring proceedings there.
These terms are between you and us, not with Apple. Apple is not responsible for Ganba or its content, and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you. If Ganba fails to conform to any warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other obligation regarding Ganba.
We may update these terms. The "last updated" date changes when we do, and material changes will be announced in the app before taking effect. Continuing to use Ganba after a change means you accept the updated terms.
